If you disagree with a VA decision, you can choose from 3 decision review options (Supplemental Claim, Higher-Level Review, or Board Appeal) to continue your case. Which appeal option you choose depends on your timeline preferences and whether you have new evidence to submit, you want a hearing, or you just want a new adjudicator to review it. Each appeal option requires a corresponding form and these forms must be filled out completely and submitted on time. Doing so will enable you to preserve your right to appeal the VA’s denial of your disability benefits.
Vets National Advocates can help you choose an appeal lane and complete the appropriate appeal forms. If, after appealing, you are still unhappy with the VA’s decision, you can try another eligible appeal option, as long as your appeal remains timely. For example, if you disagree with a Higher Level Reviewer’s decision, you can appeal to the Board of Veterans’ Appeals.
If you do appeal to the Board of Veterans’ Appeals (Board), you can select between the hearing, direct review, or evidence-submission lanes.
